Law of Obligations

Contract law and tort law are, in part, encompassed by the law of obligations. Legal facts that give rise to rights and duties—such as private transactions and harmful acts—are areas of specialization in which we excel. Moreover, the law of obligations forms the foundation of our practice, both in terms of advisory services and litigation.

Contract and obligations law is the foundation of our practice, both in advisory services and litigation. We primarily assist with commercial contracts, covering all phases of a contract’s lifecycle. Most contracts are entered into, fulfilled, and concluded in a normal manner. However, in commercial contracts, we are often contacted when something goes wrong. In the most extreme cases, this leads to litigation. There are, however, many ways to resolve contract disputes, ranging from various out-of-court settlements to legal settlements, such as court mediation.

Kristensen has specialized expertise in business transfers and company acquisitions. Our expertise is primarily sought in complex situations. For our regular clients, we assist with legal due diligence, whether on the seller’s or buyer’s side. We have handled large transactions, bringing in different professional competencies, including financial and technical expertise. These networks are available if needed.

We have extensive experience with architect and design agreements, onshore and offshore construction contracts, both in contract drafting and dispute resolution.

Kristensen’s work in shipping primarily relates to marine insurance, purchase and sale, newbuilds, chartering, financing, and dispute resolution within these business areas.

For our regular clients, we handle labor law matters and employment disputes, mainly representing employers. In termination and dismissal cases, it is crucial that we know the decision-makers and understand their motivations.

Obligations law also includes tort and insurance law, where we have specialized expertise. Compensation is financial reparation for damages, covering a broad range of legal areas. Our focus is on professional liability and similar responsibilities. Kristensen provides litigation services in areas such as:

  • Board member liability

  • CEO liability

  • Investment manager liability

  • Bank liability

  • Underwriter liability

  • Consultant and advisor liability

  • Broker liability

  • Auditor liability

  • Public sector liability

Although our main focus in tort and insurance law is litigation, many cases are resolved along the way through settlements.
