Constitutional and Administrative Law

 

Constitutional and administrative law is a foundation for Kristensen's thinking and legal advice. We assist with administrative law issues for private parties against administrative authorities. We only handle cases for private parties where either the contractual counterparty or dispute counterparty is a government or administrative body.

However, the drafting of laws and regulations can be said to be a collaboration with the public sector. For private players, we prepare proposals for legislation or regulations or participate in consultation rounds. We are currently working on changes to two specific regulations under the auspices of the Suppliers' Development and Competence Center (LUKS). The aim is to have regulations that oblige municipalities, and in particular the City of Oslo, to take into account the working environment for suppliers. The regulations are general, but only Oslo Municipality systematically fails to take suppliers into account.

We do not provide advice on tax and duty law. However, we can take on litigation assignments for well-known clients in the tax and duty area.

Litigation is practically important when working with constitutional and administrative law. We assist with dispute resolution, where litigation before the courts is the last resort. Administrative discretion and the abuse of authority doctrine are what the cases are often about.
